Why don’t more people use divorce mediation?

In a lot of ways, divorce mediation can be great for the end of your relationship, helping you figure out what to do next, determine how to split up assets, decide how to take care of your children and more. Still, for all of the help it can be, a lot of people don’t use it. Below are a handful of reasons why.

1. Spouses don’t want to sit down and talk. Mediation does require both people to meet and work together. Some spouses are too angry or resentful to do it.

2. Spouses know they can’t agree on anything. One of the benefits of mediation is that it takes some decisions out of the court’s hands and allows people to make their own agreements. For some people, due to the reasons noted above, this just doesn’t seem likely.

3. Honesty is a challenge. One person may not want to talk to his or her spouse openly and honestly. Lies in the past may also make it hard for both people to trust one another.

4. People only want to win. A mediator isn’t there to help one person win while the other loses. Instead, the mediator is supposed to take a neutral position and help find a fair agreement. If a person only wants to be the winner at the expense of his or her spouse, mediation is not going to give him or her that type of end result.

These are common reasons people don’t use mediation, but it’s important to note that that doesn’t mean they’re good reasons. It may be far better for both people to put aside their differences and seek solutions. Be sure you know how mediation can help you and the benefits it has in Florida.
